Compliance Dates Set For EPA Formaldehyde Rule

The parties in Sierra Club v. Pruitt have reached an agreement that sets the "manufactured by" dates for the Formaldehyde Act of Title VI of the Toxic Substances Control Act to June 1, 2018 for producers and fabricators of composite wood panels.

Products certified by a CARB TPC that is also recognized by EPA will be recognized as compliant until March 22, 2019.

EPA Formaldehyde Regulations Vacated

The Sierra Club won in court last week, as a federal district judge ruled that the EPA unlawfully delayed an Obama-era rule to limit formaldehyde emissions from wood products. However, the EPA will not need to comply with the court's order until it works out a plan for "effective implementation" with plaintiffs.
